Has been published a new version of the draft of the proposal for new Commission Implementing Regulation (EU) .../... laying down rules for the application of Regulation (EU) 2019/2144 of the European Parliament and of the Council as regards uniform procedures and technical specifications for the type-approval of motor vehicles with regard to their automated driving system (ADS).

This new version introduces changes to:

• Scope

• Definitions

• Administrative provisions and technical specifications for the type-approval of fully automated vehicles with regard to their automated driving system

The new version of the draft also aims toconsolidate all comments received so far. The text highlighted in the documents shows major changes or items that may need further discussion.

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union and will apply from 6 July 2022.

Proposal Summary

Scope

This Regulation applies to the type-approval of fully automated vehicles of category M and N, with regard to their automated driving system, for the following use cases:

• Fully automated vehicles designed and constructed for the carriage of passengersor carriage of goods on a predefined area in an urban or suburban environment.

• Fully automated vehicles or dual mode vehicles designed and constructed for the carriage of passengersor carriage of goods on a predefined route with fixed start and end points of a journey/trip ( “Hub-to-hub”) and which may include urban or suburban or motorway environment.

• Dual mode vehicles with a fully automated driving mode for parking applications within predefined parking facilities.

• The system may use or not external infrastructure (e.g. localization marker, perception sensors, etc.) of the parking facility to perform the dynamic driving task.

The manufacturer may apply for the individual or the type-approval under this Regulation of the automated driving system of vehicles defined in Article 2(3) of Regulation (EU) 2018/858, provided that those vehicles fulfil the requirements of this Regulation.

New version of the draft introduces a new article 2 containing definitions.

Administrative provisions and technical specifications for the type-approval of fully automated vehicles with regard to their automated driving system

The relevant entries of information document, submitted in accordance with Article 24(1), point (a) of Regulation (EU) 2018/858 with the application for type-approval of a type of a fully automated vehicle with regard to the automated driving system, shall consist of the information relevant for that system as contained in Annex I.

The type-approval of fully automated vehicles with regard to their automated driving systems shall be subject to the technical specifications set out in Annex II. Those specifications shall be assessed by the approval authorities or technical services in accordance with Annex III.

The EU type-approval certificate for a type of a fully automated vehicle with regard to the automated driving system, as referred to in Article 28(1) of Regulation (EU) 2018/858, shall be drawn up in accordance with Annex IV.
