EU – Functional requirements for market surveillance of vehicles, systems, components and separate technical units

 

A new version of the proposal for the future Commission Implementing Regulation (EU) .../... on implementing Regulation (EU) 2018/858 regarding the functional requirements necessary for the carrying out of market surveillance activities has been published. The measures to be taken under the provisions of Articles 8(15), 9(5) and 13(10) of Regulation (EU) 2018/858 concern the compliance verification of vehicles, systems, components and separate technical units. Those measures are substantively linked by their subject matter and the context in which they are to apply. It is therefore appropriate to adopt this Regulation on the basis of all three provisions in order to achieve consistent compliance verification.

The implementing act will contain the following articles:

  • Criteria for establishing the adequate scale of the compliance verification checks;
  • Format of the overview of planned market surveillance checks;
  • Format of the report of the findings following compliance verification checks;
  • Data to be made available by manufacturers to the Commission for the purpose of compliance verification;
  • Data to be made available by manufacturers to third parties for the purpose of testing for possible non-compliance;
  • Requirements for third parties to demonstrate their legitimate interest and their recourse to adequate testing facilities.

This future Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
